Constitution Education Workshop

Nasiriya
March 6, 2006

On March 6, 2006 the Iraq Foundation held a constitution education workshop for 60 political party members, civil society leaders, university professors, journalists, human rights activists, and lawyers in the Southern governorate of Nasiriya. IF held the workshop to:

  • raise public awareness
  • help protect the rights and freedoms guaranteed under article two of the constitution
  • engage civil society in promoting and consolidating democracy

The workshop focused on the rights and freedoms guaranteed in the constitution and the role that tribal leaders and civil society could play in promoting and consolidating democracy.

First Panel : Rights and Freedoms in the Iraqi Constitution

Panelists:

  • Dr. Amaar al Turki – Professor of Constitutional law at ZiGar Univeristy
  • Dr. Hosam Abd al Wahid - Professor of Law at ZiGar University

Dr. Turki pointed to the importance of the constitution in protecting individual freedoms and rights and separating the powers of the executive, judicial, and legislative branches. Dr. Turki highlighted the strengths and weaknesses of the constitution and praised the rights guaranteed under article two and six. Meanwhile, Mr Abd al Wahid focused on the freedoms and rights guaranteed under article 39 of the constitution and analyzed the personal status law of 1959.

The participants discussed with the panelists the status of Kirkuk, federalism, and the role of the executive branch in Iraq as stipulated in the constitution.

Second Panel : Tribalism, Civil Society, and Freedom of the Press.

Panelists:

  • Dr. Samir Mohsin, Lawyer
  • Mr. Walid Khashan – University professor at Nasriya University

Dr. Mohsin focused on article 43 and the role that civil society could play in drafting and amending the constitution. Dr. Mohsin also tackled tribalism in Iraq and the necessity of amending and modernizing certain tribal laws. Mr. Khashan focused on the constitutional articles that protect freedom of speech, and the significance of protecting a free press to the consolidation of democracy.
